i find the best way to avoid these is to not ignore the parking notices in car parks, but that's just me...

Kin el , not two hours after offering my thoughts on this thread, I check my post and I've got a bloody notice demanding £100 for spending 74 mins parked in a 60min limit staples car park! I've even got a receit for purchases in the shop. They won't see a penny.

No one gets court action. The company's model is to bully as much as possible and a certain percentage pay up. End of.

What if they went to court again and lost? New precedent set, they are out of business because of the publicity it would create.

They are a business that sends out invoices and some get paid and some don't, that's all this is.

I once did the whole appeal process, turned down at every turn. I even went to POPLA for an appeal, they turned it down. I never paid even then and I never heard from them again.

All they want to do is send pre printed letters and get cash back, makes no sense to actually do anything else when probably if even only 40% paid it would be highly lucrative

Follow the advice on Ted's link. It used to be the case that you would ignore these notices. These days, its generally considered you need to respond.
I followed a couple of online templates a few years ago and got the 'fine' quashed.

However, the last one I got a few months ago, I caved and paid it. I figured the time and effort to challenge it was greater than the fine itself so I paid it and forgot about it. Depends on your circumstances I guess.

The recent 'parking Eye Vs Beavis' case is a bit of a fucker as discussed below from Ted's link.

""I’ve heard the genuine pre-estimate of loss argument can get a ticket cancelled straight away?

For a long time the BPA’s independent appeal service, POPLA, routinely upheld appeals against ParkingEye tickets when the genuine pre-estimate of loss argument was made. Historical case law meant that a ticket for breach of parking conditions meant that they could only recover the loss caused by that incident (e.g. did staying 10 mins over really cause £100 loss to Parking Eye?). ParkingEye could never demonstrate this loss (because there wasn’t any), and so POPLA had to uphold such appeals. This method was very popular between 2012 and 2014 since cancellations were almost routine.

Unfortunately, the genuine pre-estimate of loss argument no longer works for ParkingEye tickets since the ParkingEye Vs Beavis case. Here, ParkingEye tried to enforce a ticket in the county court and HHJ Moloney, a senior county court judge, stated that whilst the charge did not represent any loss, it was commercially justifiable, and so could be enforced. Since the judge was senior, this was persuasive to lower courts and POPLA. The judgement was appealed by Mr Beavis to the Court of Appeal and subsequently to the Supreme Court. They found commercial justification didn’t apply, but the amount demanded was not extravagant or unconscionable, and so was enforceable despite not reflecting any loss. In light of this, the ‘GPEOL’ argument is not a ‘slam dunk’ win at appeal anymore.

However, despite what many think, the Beavis ruling does not mean parking companies can charge what they want; the judgement was more nuanced than that. In contract-based private parking, each case is different; the contract is different, as are the circumstances, and nature of the alleged breach. Rulings such as Beavis may be quoted to support the claim, but the claimant must explain how it relates to the case in question. Conversely the appelant may be able to explain why it does not apply. We discuss that in this piece.""""

I got one about a year ago. Just ignored it, straight in the bin.

Over the next 9 months got more and more letters with dire warnings about the court action that would inevitably follow. Then I got a 'final' letter saying that they had instructed for court action but I could still stop it if I rang them.

Not heard a dicky bird in the last 4 months or so.

I don't know if it's changed that much, they just put a bit more effort into trying to scare you to pay.

Looks like things have changed since I got one but having said that a friend of mine ignored a penalty charge in recent months and hasn't heard anything for ages......

They MAY initiate court proceedings if you don't pay though. At least, that's what they say in the 50 letters they'll send you over the next few months.

DO NOT contact them and just bin the so called fine and ignore all future correspondence !!!
